2018 Penrith City Council By-election

Following the resignation of two Councillors, By-elections are to be held for East and South Wards of Penrith City Council. In the event the By-elections are contested, the By-elections will be conducted on Saturday 12 May 2018. However only electors enrolled in East and South Wards of Penrith City Council will be required to vote. There is no election within North Ward.

Australian Election Company has been contracted to assist Penrith City Council manage, conduct, deliver and report the By-election process. Australian Election Company also assisted Council to deliver the 2012 and 2016 Penrith City Council Elections.

Who votes?

Voting in NSW Council Elections is compulsory for residential (electors enrolled on the Commonwealth / NSW Electoral Roll). All Australian citizens aged 18 years and older must have been enrolled on the electoral roll for the address where they live.

You can verify your enrolment and sign up for an election reminder service by visiting the Electoral Commission NSW website through the following link. Electoral enrolment can be done online, where you can also change or update your enrolment details. Alternatively, you can obtain a form and prepaid envelope from Electoral offices. The form may be returned by post, fax, email or hand delivery to an AEC office. Once your form has been processed, the AEC will send you an acknowledgement advice. If you do not receive your advice within 4 weeks you should contact the AEC via email: info@aec.gov.au or phone 13 23 26.

The rolls for the 2018 Penrith City Council By-elections for East Ward and South Ward of the Council close at 6:00pm (AEST) on 3 April 2018.

Owners of property in East or South Wards, who do not live in the Ward, but who wish to vote in the By-Elections for the Ward where they own property, are able to obtain an Application form; and send an Application to the General Manager of the Penrith City Council, to appear on the Non-residential Roll of electors or the Occupiers and Rate Paying Lessees Roll of electors, for that Ward. Voting is not compulsory for electors included on these Rolls. The deadline for receipt of completed Enrolment Claims with the Penrith City Council General Manager is 6:00pm (AEST) 3 April 2018.

Election Funding and Disclosure Provisions

Electoral Commission NSW administers and controls the Election Funding and Disclosure provisions (including Candidate Registration) associated with NSW Council Elections and all Candidates must apply to be registered for the election and appoint an Official Agent, through Electoral Commission NSW, prior to accepting political donations or incurring electoral expenditure, and prior to nominating to Council’s Returning Officer, to be a candidate at the By-election.

Nominating for Election

Any intending Candidates should refer to the Local Government Act 1993 and the Local Government (General) Regulation 2005 for full details of requirements and qualifications etc. for Nomination.

Candidates should seek their own legal advice on any areas where they have concern(s) regarding requirements, qualifications or issues or matters of interpretation.

Council, the Returning Officer or Australian Election Company will not provide any information or advice of a legal nature.

The onus is on any Candidate to ensure their Nomination is complete and made to (received by) the Returning Officer by the closing of Nominations, which for the 2018 Penrith City Council By-elections is 12 noon (AEST) 11 April 2018.

The following information provided below is of a general nature only.

Note: Electoral Commission NSW administers and controls the Election Funding and Disclosure provisions (including Candidate Registration) associated with NSW Council Elections and all Candidates must apply to be registered for the election and appoint an Official Agent, through Electoral Commission NSW, prior to accepting political donations or incurring electoral expenditure, and prior to nominating to Councils Returning Officer, to be a candidate at the Election.

There are two types of nomination:

  • Nomination Paper: Proposal by Electors (Form 2) – whereby a minimum of 2 electors enrolled in the ward can nominate a candidate.
  • Nomination Paper: Proposals by Registered Officer for Party (Form 3) whereby the Registered Officer can nominate a candidate

At the 2018 Penrith City Council By-elections, only one (1) Councillor is to be elected for the East Ward and also only one (1) Councillor for South Ward. Accordingly there will be no registration of groups or group voting in these By-elections.

At the time of nominating, the deposit for an individual candidate of $125 is payable in cash or by a cheque drawn by a deposit taking financial institution. Personal cheques are not acceptable. Payment also may NOT be made by Credit Card, by EFT, by BPAY or by Postal Order. The deposit is to be received by the Returning Officer prior to 12 noon (AEST) on Nomination day, which is 11 April 2018.

Upon Nomination by a Candidate (or Candidates), the following forms are to be lodged:

  • Completed Nomination Proposal in Form 2 or Form 3
  • Completed Candidate Information Sheet (signature to be witnessed by JP)
  • Completed Statistical Information Sheet (optional for a By-election)
  • Nomination Deposit in Cash or Bank Cheque

A Nomination is not valid without a completed Candidate Information Sheet. Valid Nominations must be received by the Returning Officer by 12 noon (AEST) 11 April 2018. Nominations may be lodged in person, by post, fax or email. Where email is used an image of the completed nomination paper signed by the proposers and the person proposed for nomination is included in or attached to the email and that image includes an image of the actual signatures, as appearing on the nomination paper. Where email is involved, the Nomination will not be made unless, in addition to the completed Nomination paper, the completed Candidate Information Sheet, the completed Statistical Information Sheet (optional for a By-election) and the Nomination Deposit was received by the Returning Officer, before the 12 noon (AEST) deadline on 11 April 2018.

NOTE: As previously mentioned, Candidates must also separately register with the Electoral Commission NSW before Nomination day for the By-election.

As soon as practicable after the close of nominations, and once Nominations are processed, the Returning Officer will formally announce candidates and conduct a draw for their ballot paper positions, for each contested Ward. The draw for ballot paper positions is expected to be conducted circa 3:00pm (AEST) on 11 April 2018.

Ballot papers include the candidates’ surname and one given name. Candidates may request to have “Independent” printed below their name. Candidates nominated by Political Parties have their affiliation (or abbreviated affiliation) printed on the ballot paper.

Where to Vote on By-Election Day

There will be Polling Places located throughout each of East and South Wards on 12 May 2018. As is conventional, these Polling Places generally are located within Schools, Community Halls etc.

Details of the locations of all Polling Places within East and South Wards are available above. The Polling Place locations will also be published in local newspapers just prior to By-election Day. The locations of Polling Places will also be included on Council’s website and are listed here both alphabetically (by name) and by ward here.

Voting before By-Election Day

If you are not going to be within your Penrith City Council Ward or you will be unable to vote on By-election day, Saturday 12 May 2018, you may vote by pre-poll or postal voting. Pre Poll voting will commence from 30 April 2018 and you can apply for a postal vote from 3 April 2018 until 5:00pm (AEST) 7 May 2018. Pre Poll voting locations are described above. Pre poll voting will be available during normal Council business hours, except that Pre Poll voting will close at 6:00pm (AEST) on 11 May 2018.
